Got
a California Red Light Camera
Ticket?
READ THIS before mailing that
check!
Let
me start by stating that I do not
advocate breaking any traffic
laws. Running a red light can
seriously hurt others or
yourself. People make mistakes --
no one is immune from that fact,
however with a fine up to $408
and the assumption that you are
automatically guilty, it's just
another blatant opportunity for
county and local governments to
gouge California drivers.
If you recently received a Red
Light Camera citation within
the State of California, then
you've come to the right place.
You are being charged with
violating section 21453 of the
California Vehicle Code. This is a moving violation which carries a penalty on your DMV driving record for 3 years and
will likely result in years of higher insurance premiums, not to mention the huge fine.
|
California
Red Light Camera Ticket
Law
California VC 21453.
(a) A driver
facing a steady circular
red signal alone shall
stop at a marked limit
line, but if none,
before entering the
crosswalk on the near
side of the intersection
or, if none, then before
entering the
intersection, and shall
remain stopped until an
indication to proceed is
shown, except as
provided in subdivision
(b).
|
The
vehicle code above is the star of
the prosecution's case but
there are a series of other
laws, not only at the state
but also at the federal level
which are important to your
situation. Understanding ALL your
rights and knowing how
the system works can
significantly improve your
chances of having your red
light camera ticket case
dismissed.
Remember,
the American justice system is
predicated on the belief that
you are innocent until
proven
guilty. But if you're not
convinced, consider these
reasons:
If you fight your California
red light camera ticket &
win, you get your money
back.
With fines reaching $408+ in
some parts of the state, a Red
Light Camera ticket can be an
expensive fine to pay.
Guaranteed
Constitutional
Rights.
By pleading not guilty, you
have certain rights such as a
right to a speedy trial,
ability to confront and cross
examine witnesses. Under a
certain set of circumstances,
your constitutional rights can
also help get your case
dismissed.
California Statutory
Requirements.
In order for a local or county
government to operate
automated enforcement
equipment, they must meet
certain state mandated
requirements. If not, your
case could be dismissed.
Computer
Glitches.
As with any advanced
technological equipment,
computer malfunctions can and
do occur. If this happens it can be
immediately used to
your advantage in court.
What's next... Photo radar on
the freeways?
Sad
to say, only 1% of drivers who
receive a Red Light Camera
citation actually contest
their violation notice. It
won't take long for the greedy
politicians in Sacramento to
consider other forms of
automated enforcement if
drivers simply pay up without
a fight.
Local
officials want you to think a Red
Light Camera is only for
vehicle safety but in reality,
Automated Enforcement is merely
an Automated Revenue
Generator.
While
local governments are quick to
cite red light running
statistics, most are also eager
to downplay the HUGE profits
generated from automated
violations in some California
cities. In fact, the greed became
so apparent, an amended Red Light
Camera law
went into effect January 1, 2004.
It was inspired by a case in
San Diego, where the (former)
Lockheed-Martin company was
operating under a ticket-based
revenue agreement. It was ruled
"untrustworthy and unreliable,"
by Superior Court Judge Ronald
Styn.

of Red Light Camera
Revenue in
California
San Diego, CA - A
single red light camera
generated the City of
San Diego $6.8 million
in only 18 months.
San Diego

Sacramento, CA -
"Red light cameras
generate an estimated
$800,000 a year."
Sacramento
Bee
West Hollywood,
CA - "West Hollywood
collected an estimated
$4.9 million during the
first 12 months of
operation." Los

Known
as the Red Light Reform
Bill, AB
1022
prevents Red Light Camera vendors
from being paid based on the
number of citations they issue.
However... local governments who
approved their use prior to the
January 1, 2004 deadline were
grandfathered, thus exempt
from the requirement. Not
surprising, cities such as
Oceanside, Vista,
Del Mar and
Encinitas quickly approved
the use of Red Light Cameras so
they could operate under the old
version of the law.
Let
SHOOT BACK! show you how to
easily Defend your Red Light
Camera case in any California
traffic court.
Let's
face it, going to any California
traffic court is a pain. No one
wants to waste their time at a
place which makes you feel like
you have no chance of winning.
And that is EXACTLY what the
courts want you to think: it's
far easier to pay the fine or
take traffic school than to fight
your ticket. In reality, they've
set up the system for revenue, not for
justice.
Unfortunately, most drivers are
completely unaware of their legal
rights when they attend traffic
court. That's
why most unprepared drivers are
quickly found guilty.
Don't let this happen to you if
you're holding a red light camera
ticket!
Shoot Back! will help you
build a defense and exercise your legal
rights. Regardless of a document
accusing you of violating a
traffic law, local and county
governments are required to
prove it in a court of law.
SHOOT BACK! will provide you with
up-to-date information about laws
concerning red light camera units
and examples of real traffic
ticket cases to help you in your
fight for justice.
Costumer Review

Well
worth the
investment!
I purchased a copy of
SHOOT BACK! last
night for a court case
this morning in Long
Beach and I cannot thank
you enough.
Armed with the
information in SHOOT
BACK!, I was able to get
my red light camera
ticket case dismissed
after making my first
motion. The judge had no
choice in the matter
because the law was on
my side.
I look forward to
receiving my refund
check from the Long
Beach traffic court.
Thanks again!

From another customer who beat their ticket...
|
I
hate red light camera
units because I think
it's an invasion of
one's personal privacy.
While I know a few
friends who received a
red light camera ticket,
I didn't realize how
much the fine was until
I received a traffic
citation in the mail.
$351... ridiculous!
And yes, I was skeptical
when I first saw your
legal how-to
publication: Shot Back,
however after
downloading the eBook, I
quickly realized that
there is more than one
method to fight my red
light camera ticket
within the state of
California.
Using your "County Seat"
defense strategy, the
red light representative
was a no-show, thus my
traffic citation was
dismissed.
I highly recommend your
publication to any
California driver.
Kudos to Shoot
Back!

From another happy customer ...
|
Even
if you think you're
guilty of receiving a
red light camera ticket,
I suggest you fight your
ticket. While you may be
"guilty" of committing
the traffic offense, the
state and local
government MUST prove
you actually did do the
crime. Despite what most
drivers think, you
actually use California
law to show how many
obstacles that law
enforcement must overcome just
to issue one red light
camera ticket.
Great job guys!

Despite
SHOOT BACK's easy-to-use legal
defense strategies for Red Light
Camera Tickets, it does have some
limitations...
SHOOT
BACK! is not a cure-all for
various types of traffic
violations.
In order for the reader to gain
the most, SHOOT BACK! only
focuses on Red Light Camera
citations. Here are a few
situations where SHOOT
BACK! will not be able to
help you:
Red Light Camera Traffic
Violations Outside of
California.
SHOOT BACK! is only
written for those who received
a red light photo violation
within the state of

Red Light
Tickets.
If you were actually pulled over and cited by a police officer for

SHOOT BACK! will not be able
to assist you. SHOOT BACK!
only focuses on red light
camera citations issued from an automated
enforcement unit.
Looking for legal
advice.
SHOOT BACK! provides legal
information, not legal advice.
If you have questions about
your red light camera case,
seek the advice of a licensed
California traffic

In a Kangaroo

appeal your red light camera
